This Refund Policy (“Policy”) sets forth the terms and conditions under which Schiv Innovative Products Pvt. Ltd., a company incorporated under the Companies Act, 2013, and having its registered office at [Insert Full Address] (hereinafter referred to as the “Company”, “we”, “our”, or “us”), shall entertain and process refund claims raised by purchasers (“Customer,” “Client,” “you,” or “your”) in respect of goods and services transacted through our digital platform www.schivindia.in.

This Policy is integral to, and read in conjunction with, our Terms of Use and Privacy Policy.

1.   Binding Effect

1.1 By initiating a transaction with the Company, you hereby acknowledge that you have read, understood, and agreed to be legally bound by the terms set forth herein.

1.2 The Company reserves the exclusive right to amend, alter, revise, or rescind any part of this Policy, without prior notice, at its sole discretion. It is your responsibility to periodically review this Policy.

2.   Refund Eligibility Criteria

2.1 Refunds shall only be entertained under the following conditions:

  • The product or service delivered is materially defective, non-functional, or not as represented at the point of purchase;
  • A technical or system error on the Company’s part has resulted in duplicate billing or unauthorized transactions;
  • Non-delivery of product or failure to provide access to the purchased service within the stipulated timeframe, without justifiable cause.

2.2  All requests for refunds must be initiated within seven (7) calendar days from the date of the transaction. Failure to do so shall constitute an irrevocable waiver of the right to claim a refund.

2.3  The onus shall be on the Customer to provide complete documentation, including but not limited to: order ID, transaction details, screenshots, and email records, evidencing the basis for refund.

3.   Non-Refundable Transactions

3.1 Refunds shall not be entertained in respect of the following:

  • Services that have been commenced, partially availed, or completed;
  • Digital goods or software that have been downloaded, activated, or accessed;
  • Customized products or tailor-made solutions specifically created for the Client;
  • Subscription plans, unless expressly stated otherwise in a written agreement;
  • Promotions, bundled offers, time-limited discounts, and vouchers.

3.2 No refund shall be provided in the event of misuse of services, violation of terms, or any behavior constituting abuse of the Company’s platforms or resources.

4.   Refund Procedure

4.1 Refund requests must be submitted in writing to:  📧 info@schivindia.in  with the subject line: “Refund Request – Order #[Insert Order ID]”.

The request must include:

  • Full legal name of the purchaser;
  • Date and method of payment;
  • Order reference and invoice number;
  • Detailed reason for requesting a refund;
  • All relevant supporting documentation.

4.2 The Company shall review the request within ten (10) business days. If deemed valid, the refund shall be processed promptly. If additional clarification is required, the refund process shall be paused pending Client response.

5.   Refund Timeline and Method

5.1 Upon approval, refunds shall be processed within fifteen (15) business days via the original method of payment, unless otherwise mutually agreed.

5.2 The Company disclaims liability for delays caused by third-party payment processors, financial institutions, or force majeure events.

6.   Chargebacks and Payment Disputes

6.1 Initiating chargebacks or disputes without first attempting to resolve the matter with the Company shall be deemed to be in bad faith.

6.2 In the event of an unjustified chargeback, the Company reserves the right to:

  • Suspend or terminate Client access to any services.
  • Pursue legal or recovery proceedings;
  • Report the incident to relevant authorities or blacklist the Client across platforms.

7.   Governing Law and Jurisdiction

7.1 This Policy shall be governed by and construed in accordance with the laws of the Republic of India.

7.2 The courts of Pune, Maharashtra shall have exclusive jurisdiction over any disputes arising from or in relation to this Policy.

 

8.   Severability

Should any clause or provision of this Policy be deemed unenforceable or invalid under applicable law, such invalidity shall not render the entire Policy unenforceable, and all remaining provisions shall remain in full force and effect.
